About these Terms: This website is owned and operated by Swimfast.co.za. By accessing or using the website or our services, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the site.
Who may use the site : You must be at least 18, or the legal age of majority where you live, and able to enter into a binding agreement. Do not use the site or services where doing so is prohibited by any law that applies to you.
Purchases and pricing: Read the full item listing before you buy. When you complete the checkout and payment process you enter into a legally binding contract to purchase that item. Prices are shown on the website. We may change prices and correct any pricing errors at any time. All sales are final, and no returns or refunds are given, so please confirm every purchase before you complete it.
Freestyle video analysis: upload window Once you have paid for a freestyle video analysis, you have 30 days from the date of payment to upload your videos in line with the requirements for the service. If we do not receive your footage within that period, the service is treated as delivered in full and there is no further claim against Swimfast.co.za.
eBook downloads: If you have trouble downloading an eBook, please contact info@swimfast.co.za and we will help you. We are not responsible for problems caused by a third-party app.
Content you submit: By sending us your swimming footage for a freestyle video analysis, you confirm that you own it or have the right to share it, and you agree that Swimfast.co.za may display it on the website and use it in our marketing across social media and other channels.
Intellectual property: All content on the site and in our services, including software, images, text, eBooks, graphics, logos, trademarks, photographs, audio, video and all related rights, is the property of Swimfast.co.za. You may not copy, sell, licence, rent, modify, distribute, publish or create derivative works from it without our permission.
Health and safety: Our services provide information about swimming and swimming technique. This is not medical advice and should not be treated as such. Check with your doctor before starting any exercise programme. If you are, or believe you may be, injured, consult an appropriate medical professional and do not delay or disregard medical advice because of information from our services. Only swim in pools with lifeguard cover and in open water with appropriate safety cover. You are responsible for your own health and safety while swimming, and Swimfast.co.za is not liable for any injury you may suffer while following our suggestions.
Changes to our services and your access: We may change, limit, suspend or stop any part of our services at any time, with or without notice. You may stop using the services at any time. Where you hold a paid subscription, it continues until the end of the period you have already paid for.
Third-party links: Our site may link to third-party websites and materials that are not affiliated with us. We are not responsible for their content, accuracy or practices, and any dealings with them are at your own risk. Please review their policies before you engage with them.
Accuracy of information: We try to keep the information on our site correct, but we do not warrant that it is always accurate, complete or current. Any reliance on it is at your own risk, and we may update or correct it at any time without notice.
Limitation of liability: To the maximum extent permitted by law, Swimfast.co.za and its owners, employees and operators are not liable for any indirect, incidental, special, punitive or consequential loss, including loss of profits, data or goodwill, or for any errors, personal injury, property damage, or unauthorised access to data, arising from your use of, or inability to use, the services. Our services and products are provided "as is" and "as available" without warranties of any kind, express or implied. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.
Indemnity: You agree to hold Swimfast.co.za and its owners, employees and operators harmless from any claims, losses, liabilities or expenses, including legal fees, made by any third party arising from your use of the website or services.
Marketing emails: We may send you occasional promotional messages. You can opt out at any time by emailing info@swimfast.co.za.
Changes to these Terms: We may update these Terms from time to time at our discretion. Your continued use of the site after a change means you accept the current version, so please review this page periodically.
Governing law: These Terms are governed by the laws of South Africa, and any dispute will be dealt with exclusively by a court of competent jurisdiction in South Africa.
